Welcome to Matthewbrunken.me (“Site”). These Terms of Use (“Terms”) govern your access to and use of the Site, including any content, functionality, and services offered on or through the Site. By accessing or using the Site, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

1. Acceptance of Terms

By accessing the Site, you (“User” or “you”) acknowledge that you have (and will) thoroughly read all material on the Site. Your use of the Site constitutes your agreement to these Terms and any additional terms referenced herein.

2. Changes to Terms

Matthew Brunken (“we”, “us”, or “our”) reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site after such changes constitutes your acceptance of the new Terms.

3. Use of the Site

  • Eligibility: You must be at least 18 years old to use the Site. By accessing the Site, you represent and warrant that you meet this age requirement.

  • License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site for personal, non-commercial purposes, in accordance with these Terms.

4. User Obligations

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Site. Prohibited behavior includes, but is not limited to:

  • Engaging in any unlawful act or activity.

  • Transmitting or distributing any material that is defamatory, obscene, invasive of privacy, or otherwise objectionable.

  • Attempting to gain unauthorized access to any portion of the Site or its related systems.

5. Accuracy of Information

By accessing the Site, you agree that the information presented is true and correct to the best of your knowledge. We strive to maintain accurate and up-to-date content; however, we do not warrant the completeness or accuracy of any information on the Site.

6. Retractions and Corrections

If you believe that any material on the Site is inaccurate or requires correction, you must request a retraction or correction within 7 days of first discovering the material and/or within 30 days of the material being posted—whichever comes first. Requests must comply fully with Nebraska Revised Statutes § 25-840.01 and be served as follows:

All retraction or correction requests must be sent via certified mail, return receipt requested.

7. Intellectual Property Rights

  • Ownership: All content on the Site, including text, graphics, logos, images, and software, is the property of Matthew Brunken or its content suppliers and is protected by United States and international copyright laws.

  • Restrictions: You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent.

8. Disclaimer of Warranties

The Site and its content are provided on an “as is” and “as available” basis. We disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, Matthew Brunken shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Site.

  • Any unauthorized access to or use of our servers and/or any personal information stored therein.

  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Site by any third party.

  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Site.

10. Indemnification

You agree to indemnify, defend, and hold harmless Matthew Brunken, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, any content submitted by you.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within Nebraska for the resolution of any disputes arising out of or relating to these Terms or your use of the Site.

12. Dispute Resolution

  • Informal Resolution: To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms or the breach thereof, the parties agree to first attempt to resolve the dispute informally by contacting the other party.

  • Binding Arbitration: If the dispute cannot be resolved through informal negotiations, it shall be finally resolved by binding arbitration administered by the American Arbitration Association in accordance with its rules. Judgment on the arbitration award may be entered in any court having jurisdiction.

13. Termination

We reserve the right to terminate or suspend your access to all or part of the Site, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Site will immediately cease.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, the remaining provisions will continue in full force and effect. The invalid, illegal, or unenforceable provision will be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable.

15. Entire Agreement

These Terms constitute the entire agreement between you and Matthew Brunken regarding your use of the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.

16. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

17. No Partnership

These Terms do not create any partnership or joint venture, and you agree that you do not have any authority of any kind to bind Matthew Brunken in any respect.

18. Media Publisher and First Amendment Protections

By using the Site, you agree and acknowledge that the Site is a media publisher within the context of First Amendment protections. As such, the content published on the Site is protected under the First Amendment, and Matthew Brunken exercises editorial control over the content without undue interference.
